Brazilian Tax Exit
Moved overseas? Ensure your Brazilian tax affairs are in order with confidence and specialist guidance.
The Definitive Departure Tax Return (Declaração de Saída Definitiva do País – DSDP) is a tax filing obligation for individuals who cease to be tax residents in Brazil.
In general, an individual becomes a non-resident for Brazilian tax purposes when they leave Brazil permanently or, in the case of a temporary departure, after 12 consecutive months of absence.
Under Receita Federal Normative Instruction No. 208/2002, the return must be submitted by the last working day of April of the year following the date on which the individual becomes a non-resident for tax purposes. It is worth noting, however, that in recent years this deadline has been extended to the last working day of May, in line with the filing deadline for the Brazilian Annual Income Tax Return.
How can Mosaico Tax help?
At Mosaico Tax, we provide tailored assistance throughout the process, from the initial assessment of your tax circumstances, conducted through an online consultation with one of our specialists, to the preparation and submission of the return.
Ceasing to be a Brazilian tax resident can have significant tax implications, including changes to the taxation of Brazilian-source income, applicable tax rates and reporting obligations to the Receita Federal.
In certain circumstances, such as the sale of residential or rural properties, receipt of inheritances, rental income, pensions, financial investments, shareholdings, agricultural activities and private pension arrangements, ceasing to be a Brazilian tax resident may give rise to specific tax consequences that should be carefully considered as part of international relocation planning.
We assess these implications on a case-by-case basis, helping clients understand the potential tax consequences and identify the most appropriate options for their circumstances.
Our strength lies in our international tax expertise, supported by a team of lawyers and accountants with professional qualification in Brazil and the United Kingdom, and the expertise to analyse tax matters involving other jurisdictions.
Our assessment goes beyond Brazilian-source income, taking into account each client's overall financial circumstances and worldwide assets, including overseas investments and income, as well as potential international tax implications and the application of double taxation agreements, where relevant.
Left Brazil years ago without formalising your departure for tax purposes?
We also provide specialist assistance with regularising departures that took place in previous years.
Depending on the circumstances, it may be possible to submit tax returns for previous years or complete procedures to update your tax registration details with the Brazilian Federal Revenue Service, including cases where the individual left Brazil more than five years ago.
Each case requires an individual assessment, taking into account the client's tax history, date of departure from Brazil, any outstanding obligations and the associated tax consequences.
Our work begins with an online consultation with one of our specialists. This initial meeting is dedicated to understanding the particular circumstances of each case, addressing the main questions and assessing the potential tax implications of ceasing to be a Brazilian tax resident.
Based on this assessment, we seek to identify the most appropriate procedures and solutions, adopting a practical, objective and tailored approach.
Benefit from Mosaico Tax's international expertise in bringing your Brazilian tax affairs into order with clarity and confidence.
